Categories of personal data that are processed
We process only data that is related to the conclusion of the contract or pre-contractual measures. This may include identification and/or contact information regarding you or individuals at your company, as well as, if applicable, any other data you provide to us in connection with the conclusion of the contract.
Purposes and Legal Bases for Processing
To the extent that personal data is necessary for the initiation or performance of a contractual relationship or in connection with the implementation of pre-contractual measures, such processing is lawful pursuant to Article 6(1)(b) of the GDPR. If you give us your explicit consent to process personal data for specific purposes (e.g., disclosure to third parties, analysis for marketing purposes, or promotional communications via email), the lawfulness of this processing is based on your consent pursuant to Article 6(1)(a) of the GDPR. Consent that has been given may be revoked at any time with future effect (see “Data Subject Rights”). Where necessary and permitted by law, we process your data beyond the actual contractual purposes to fulfill legal obligations pursuant to Article 6(1)(c) of the GDPR. In addition, processing may take place, where applicable, to protect our legitimate interests or those of third parties, as well as to defend against and assert legal claims pursuant to Article 6(1)(f) of the GDPR. Where applicable, we will inform you separately, specifying the legitimate interest.
Period for which personal data is stored
To the extent necessary, we process and store your personal data for the duration of our business relationship or to fulfill contractual purposes. This includes, among other things, the initiation and execution of a contract. In addition, we are subject to various retention and documentation requirements arising, among other things, from the German Commercial Code (HGB) and the German Fiscal Code (Abgabenordnung). The retention and documentation periods prescribed therein range from two to ten years. Finally, the retention period is also determined by the statutory limitation periods, which, for example, under Sections 195 et seq. of the German Civil Code (BGB), are generally three years but may extend up to thirty years in certain cases.
Obligation to Provide Personal Data
The provision of personal data for the purpose of deciding whether to enter into a contract, fulfilling a contract, or carrying out precontractual measures is voluntary. However, we can only make a decision in connection with contractual measures if you provide the personal data necessary for the conclusion of the contract, the performance of the contract, or precontractual measures.
Disclosure and Foreign Connections
Recipients of Personal Data
We disclose your personal data within our company exclusively to those departments and individuals who need this data to fulfill contractual and legal obligations or to pursue our legitimate interests. Otherwise, data will only be disclosed to recipients outside the company to the extent that legal provisions permit or require it, the disclosure is necessary for the performance and thus the fulfillment of the contract or, at your request, for the implementation of precontractual measures; we have your consent; or we are authorized to provide the information.
Transfer of Personal Data to a Third Country
As a general rule, we do not transfer any data to a third country. Personal data will only be transferred to countries outside the EEA (European Economic Area) or to an international organization to the extent that this is necessary for the performance and thus the fulfillment of the contract or, at your request, for the implementation of precontractual measures; the transfer is required by law; or you have given us your consent.
Rights of Affected Individuals
Withdrawal of Consent (Art. 7 of the GDPR)
You may revoke any consent you have given at any time, effective for the future, without this affecting the lawfulness of the processing that has taken place to date.
Right to Object to Processing (Art. 21 of the GDPR)
You have the right to object to the processing of your personal data.
Additional Rights Regarding Your Data
You also have the right to access, correct, delete, and restrict the processing of your data.
